Constitution and Bylaws
of CAHPERD

PREAMBLE
The purposes of education in a democracy are rooted in the lives of the
people and are founded upon those democratic and fundamental freedoms which
responsible citizens proclaim and esteem in these United States. Education for
effective democratic living is dedicated to the objectives of self-realization, human
relationships, economic efficiency, and civic responsibility. The interdependent
areas of
health education, physical education, recreation and dance fall within
the framework of the democratic process and are conceived as making significant and
unique
contributions to the achievement of the purposes and goals of all
education. To
provide for unity of purpose, cooperative and concerted action,
intelligent direction and control, and to make the greatest contribution to the goals of
education, the Colorado Association for Health, Physical Education, Recreation and
Dance is hereby reorganized, and the following Constitution and Bylaws are adopted.
ARTICLE I. NAME

Section 1.
- The organization shall be called the Colorado
Association for Health, Physical Education, Recreation and Dance.
ARTICLE II. AIMS

Section 1.
- The aims of the Colorado Association for Health, Physical
Education, Recreation and Dance are consistent with the aims of general
education and relate specifically to health education, physical education,
recreation and dance. They are:
- Provide conferences, workshops and conventions based upon the needs
and interest of the membership.
- Provide leadership opportunities essential to the continued
development of quality programs in health education, physical education, recreation and dance.
- Educate and inform Colorado citizens regarding the benefits of health
education, physical education, recreation and dance.
- Support research projects and innovative programs.
- Establish communication and develop collaborations with related
associations.
- Improve the management and operation of the CAHPERD organization.
ARTICLE III. MEMBERSHIP

Section 1.
- The Colorado Association for Health, Physical Education, Recreation
and Dance
shall consist of members as hereinafter provided.
ARTICLE IV. ORGANIZATION
-
Section 1.
- The organization shall include divisions, and sections, as
hereinafter provided.
ARTICLE V. GOVERNMENT
-
Section 1.
- The business of the Colorado Association for Health, Physical
Education, Recreation and Dance shall be conducted by an Executive Board, meetings of
which are
open to the membership.
ARTICLE VI. MEETINGS
-
Section 1.
- The Association shall conduct regular and special meetings.
ARTICLE VII. PUBLICATIONS
-
Section 1.
- The Association shall publish a newsletter and journal.
ARTICLE VIII. AMENDMENTS
-
Section 1.
- This constitution may be amended at any official meeting of the
membership or
by mail vote. An affirmative vote equivalent to two-thirds of the
voting members present at any regular or special meeting or an affirmative vote
equivalent to
two-thirds of the mail vote cast shall be required for amendment. No
mail vote shall be valid beyond thirty days after official notification.

Section 2.
- The membership shall be notified of any proposed amendments of the
constitution or bylaws by mail at least thirty days prior to the meeting of the
Association.

Section 3.
- All amendments shall be published after such amendments are passed.
BYLAWS
ARTICLE I. MEMBERSHIP
Section 1.
- Membership in the Colorado Association for Health, Physical
Education, Recreation and Dance shall be designated as regular members, retired members,
student members, honorary members, associate members and life members.

Section 2.
- Regular members shall consist of persons professionally engaged in
any aspect
of health education, physical education, recreation and/or dance or
allied professions. Regular members shall have voting privileges and may hold office.

Section 3.
- Retired members shall include people who are retired from full time
employment in any aspect of health education, physical education, recreation
and/or dance
or allied professions and who were CAHPERD members. Retired members may
not vote
or hold office.

Section 4.
- Student members shall include students preparing for a profession in
health education, physical education, recreation and/or dance. Student members
do not have voting privileges and may not hold office.

Section 5.
- Honorary members shall be persons recognized for distinguished
service in the
fields of health education, physical education, recreation and/or
dance. The Executive Board shall have the right to award honorary membership.
Honorary membership is for one year and includes regular membership privileges exclusive
of voting and holding office.

Section 6.
- All past presidents of the Colorado Association for Health, Physical
Education, Recreation and Dance shall be awarded Life Membership status upon
completion of the last day of their entire term as president. These members have
regular membership privileges but do not pay dues.

Section 7.
- An associate membership shall be available to interested groups,
organizations, or commercial concerns. Associate members may not vote or hold office
but may
receive publications and qualify for advertising/exhibit discounts
and/or privileges approved by the Executive Board.

Section 8.
- The annual dues for regular members shall be twenty dollars
($20.00). The annual dues for retired members shall be twelve ($12.00). The annual dues
for student members shall be seven dollars ($7.00). There are no dues for
honorary membership. The annual dues for associate members shall be fifty dollars
($50.00).
ARTICLE II. OFFICERS
Section 1.
- The officers of the Association shall consist of the President,
President-elect, immediate Past President, Executive Secretary, the Chairpersons and
Chairpersons-elect of the divisions of Adaptives, Athletics, Dance, General,
Health Education, Physical Education, and Recreation, as well as the Secretary,
Secretary-elect, Treasurer and Treasurer-elect.

Section 2.
- The President shall act as chairperson of the Executive Board and the
regular
meetings as hereinafter provided. He/she shall appoint all members of
committees except the nominating committee. He/she shall appoint annually a
public accountant to audit the books and accounts of the Treasurer. The President
shall: serve as representative on the Representative Assembly of the American
Alliance of Health, Physical Education, Recreation and Dance; serve as chairperson and
be responsible for the organization of the state convention; make an annual
report of his/her administration to the Executive Board and administer other duties
as defined in the President's Operating Code.

Section 3.
- The President-elect shall act for the President in
his/her absence
and, in case the office of President is vacated, shall become President
for the
unexpired term in addition to his/her regular term. The President-elect
shall be
a member of the Executive Board, assist the President with the
organization of the state convention, and perform such other duties as defined in the
President-Elect's Operating Code.

Section 4.
- The immediate Past President shall be a member of the
Executive Board and the state convention committee. He/she shall give the President
the benefits of his/her experience, chair the nominating committee, chair the
Past President's committee, and aid the current administration in every way.

Section 5.
- The Secretary shall keep a record of proceedings of
the Association and Executive Board. He/she shall make annual reports of the
proceedings and status of the Association to the Executive Board and the American Alliance
of Health, Physical Education, Recreation and Dance. The Secretary shall
perform other
duties as outlined in the Secretary's Operating Code and shall receive
and file annual reports and official communications as provided in these bylaws.

Section 7.
- The Treasurer shall receive dues for membership in
the Association. He/she shall prepare a final annual financial report and prepare books
for auditing and perform other duties as outlined in the Treasurer's Operating Code.

Section 8.
- The Chairpersons and Chairpersons-elect for
Adaptives, Athletics,
Dance, General, Health Education, Physical Education and Recreation shall
be responsible for their respective divisional programs at the state
convention. The Chairpersons shall make reports for their respective divisions to the
Executive Board and perform such other duties as are defined by the officers operating
codes.
ARTICLE III. NOMINATION AND ELECTION OF OFFICERS
Section 1.
- The nominating committee shall consist of the Past
President, who
shall chair the committee, the President, and the President-elect. The
chairperson of the nominating committee shall publish a request for suggestions
from all regular members of the Association for nominations for all officers. The
responsibility of the nominating committee shall be to prepare a slate of
officers incorporating suggestions from all regular members of the Association following
publication of a request for such suggestions.

Section 2.
- To be eligible to run for office, nominees must be
regular or life
members. The President-elect shall have served previously on the
Executive Board and shall have been a member of AAHPERD for two previous consecutive years.

Section 3.
- The nominating committee shall select the slate for
the following
offices: President-elect, Secretary-elect, Chairperson-elect for the
divisions of Adaptives, Athletics, Dance, General, Health Education, Physical
Education, and
Recreation. The Treasurer-elect shall be nominated every other year.
The nominating committee shall secure the written acceptance and biographical
sketch from
the candidate before placing his/her name on the slate. The biographical
sketch
of each candidate shall be published prior to the convention.

Section 4.
- The nominating committee shall present its slate of
officers to the membership at the state convention of the Association.

Section 5.
- Officers mentioned in Section 3 of this Article shall
be elected by voice vote at the state convention of the Association. If a vacancy
occurs in
an elected office, it shall be filled by vote of the Executive Board. All
of the
elected officers except for the treasurer-elect shall automatically
succeed to office immediately following the state convention. The Treasurer-elect
shall assume office after the state convention and serve two years as Treasurer.

Section 6.
- The Executive Secretary shall be appointed by the
Executive Board
to serve an indeterminate term.
ARTICLE IV. EXECUTIVE BOARD

Section 1.
- The Executive Board shall consist of the President,
President-elect, immediate Past President of the Association, Chairpersons and
Chairpersons-elect of the divisions of Adaptives, Athletics, Dance, General, Health
Education, Physical Education and Recreation; Secretary, Secretary-elect, Treasurer,
Treasurer-elect, Executive Secretary, two Student Representatives, Student Section
Sponsor, a PEPI Coordinator, a Jump For Heart Coordinator, and Editor(s) of
Publications.

Section 2.
- The President shall appoint the Student Section
Sponsor, two Student Representatives, a PEPI Coordinator, the Editors of Publications and
Jump For
Heart Coordinator. The Executive Secretary is appointed by the Executive
Board.
Appointed members shall serve one year and may be re-appointed
annually. Appointed members are non-voting members of the Board.

Section 3.
- Members of the Executive Board may be represented by
proxy if the
proxy is a regular member of the Association. One-third of the elected
members of the Executive Board present in person or by proxy shall constitute a
quorum for
transacting business.

Section 4.
- The Executive Board shall be responsible for the
finances of the Association. The fiscal year shall begin January 1.

Section 5.
- The Executive Board shall initiate and transact all
business essential for the conduct of the Association. It shall make an annual report
to the membership at the state convention.
ARTICLE V. ORGANIZATION

Section 1.
- The Colorado Association shall include seven main
Divisions as follows: Adaptives, Athletics, Dance, General, Health Education, Physical
Education
and Recreation. The term "Division" refers to professional areas in the
fields of education or recreation.

Section 2.
- Sections within a division may be formed and assigned
to this Association as needs and interests develop. A chairperson of the section may
be appointed by the President and shall serve as a non voting member of the Board.
ARTICLE VI. COMMITTEES

Section 1.
- The President, with the approval of the Executive
Board, shall appoint special President's committees as needed for the task of completing
special
projects and which shall terminate when the project is completed.

Section 2.
- All Committee Chairpersons must submit a report at each
Executive
Board meeting. The reports requested shall consist of all pertinent
items of interest to the Executive Board and general membership - including but not
limited
to - the results of the convention evaluations, membership concerns and
goals and objectives.
ARTICLE VII. MEETINGS

Section 1.
- The Association shall conduct a business meeting at
the annual state convention.

Section 2.
- Special meetings may be called by the President with
the approval
of the Executive Board or a written request of ten percent of the regular
membership, subject to the approval of the Executive Board.

Section 3.
- The Executive Board shall meet regularly to conduct
the business of the Association.
ARTICLE VIII. PUBLICATIONS
-
Section 1.
- The membership shall be kept informed of the
activities of the Association through a newsletter and journal. Other materials may be
published and/or distributed at the discretion of the Executive Board.

Section 2.
- The journal shall be called COLORADO JOURNAL OF
HEALTH, PHYSICAL EDUCATION, RECREATION AND DANCE. It's purpose shall be to inform the
Association
of professional research and information.

Section 3.
- The newsletter shall be called THE COMMUNICATOR. Its
purpose shall be to inform the membership of current Association and Alliance events,
issues and happenings. The PEPI Coordinator shall serve as editor.
ARTICLE IX. RULES OF ORDER

Section 1.
- Methods of procedure shall be in accordance with
Sturgis Standard
Code of Parliamentary Procedures.
ARTICLE X. AMENDMENTS
-
Section 1.
- These bylaws may be amended at any official meeting
of the membership or by mail vote of the membership. An affirmative vote of two-thirds
the membership present at an official meeting or two-thirds of the mail vote
cast shall
be required for amendments. No mail vote shall be valid beyond thirty
days after official notice. All amendments shall be published.
